Terms of Service

1. Agreement and Eligibility

These Terms of Service (“Terms”) govern your access to and use of LushAIEdu, also known as PLS (the “Service”), operated by LushAITech (“we”, “us”, “our”).

By creating an account, enrolling in a course, joining an organization, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be able to form a binding contract under applicable law. If you use the Service on behalf of a school or organization, you represent that you have authority to bind that entity.

2. Accounts and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.

You agree to provide accurate registration information and keep your profile up to date. We may suspend or terminate accounts that contain false, misleading, or fraudulent information.

We may offer login via email and password, one-time passcode (OTP), or other methods we support from time to time.

3. Organizations, Classes, and Roles

Schools and organizations may invite users with specific roles (such as student, teacher, parent, or administrator). Role permissions determine what data you can view and actions you can take.

Organization administrators are responsible for their members’ use of the Service within their org. Invitations to join an organization may require your acceptance before certain roles become active.

Attendance, assignments, timetables, announcements, and related features are provided for educational purposes and depend on data entered by authorized users.

4. Courses, Enrollments, and Payments

Some courses and certifications require payment. Prices, schedules, and enrollment conditions are displayed at the time of purchase or as communicated by your organization.

Payments are processed through Razorpay or other payment partners we designate. By completing a purchase, you also agree to the applicable payment provider’s terms.

Refund and cancellation policies vary by course, batch, or organization policy stated at enrollment. Unless otherwise specified, fees for completed or partially consumed services may not be refundable.

5. AI Learn Features

The Service includes AI-assisted learning tools that generate explanations, quizzes, and chat responses. AI output is provided for educational support only and may be inaccurate or incomplete.

AI Learn is not a substitute for professional, medical, legal, or other specialized advice. Do not rely on AI responses for high-stakes decisions. You are responsible for verifying important information with qualified instructors or sources.

6. Acceptable Use

You agree not to:

• Violate any law, regulation, or third-party rights.
• Share account credentials or attempt to access another user’s account without permission.
• Upload malware, spam, harassing content, or material that infringes intellectual property.
• Reverse engineer, scrape, or overload the Service except as permitted by law.
• Use the Service to cheat on assessments or misrepresent academic work as your own where prohibited by your institution.
• Circumvent security, billing, or access controls.

7. Intellectual Property

The Service, including software, design, logos, and course materials provided by LushAITech, is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal or authorized organizational learning.

You retain ownership of content you submit (such as assignment uploads), but grant us a license to host, display, and process that content as needed to operate the Service.

8. Suspension and Termination

We may suspend or terminate your access if you violate these Terms, pose a security risk, or if required by law. Organization administrators may remove members from their organization.

Upon termination, your right to use the Service ends. Provisions that by nature should survive (including disclaimers, limitations of liability, and governing law) will remain in effect.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUSHAITECH AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR ONE THOUSAND INDIAN RUPEES (INR 1,000), WHICHEVER IS GREATER.

10. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India shall have exclusive jurisdiction over disputes arising from these Terms, subject to any mandatory consumer protection rules in your jurisdiction.

11. Changes

We may modify these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
