Overview
Please read these Terms and Conditions ("Terms") carefully before using LushAIEdu ("the App"), a Personalised Learning System provided by LushAITech ("we", "us", or "our").
Acceptance of Terms
By creating an account, signing in, or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.
The Service
LushAIEdu provides digital tools for students, teachers, parents, and school administrators, including personalised learning content, AI-assisted tutoring, quizzes, attendance tracking, timetables, fee records, announcements, academic calendars, and parent-student linking. Features available to you depend on your role and your institution's configuration.
Eligibility and Accounts
You must provide accurate registration information. You are responsible for keeping your login credentials secure and for all activity under your account. Notify your institution or us immediately if you suspect unauthorised access. Teachers and administrators may require a valid invite code. Accounts may need approval by a school administrator before full access is granted.
Roles and Responsibilities
Students
Use the App for legitimate learning, complete assigned work honestly, and follow your school's code of conduct and academic integrity rules.
Teachers
Use the App to support instruction, record attendance accurately, publish announcements appropriately, and communicate professionally with students and parents through approved features.
Parents and guardians
May access information only for students you are authorised to link to your account. Do not share link tokens or QR codes with unauthorised persons.
Administrators
Manage users, classes, institutions, and school data in accordance with school policies and applicable law.
Acceptable Use
You agree not to
Use the App for any unlawful, harmful, or fraudulent purpose
Share account credentials or attempt to bypass access controls
Harass, bully, or impersonate others
Upload malicious code or attempt to disrupt the Service
Copy, scrape, or reverse-engineer the App except as permitted by law
Use AI features to cheat on assessments or violate academic integrity rules
Misuse another person's personal or academic data
We and your institution may suspend or terminate access for violations.
AI Tutoring and Educational Content
AI-generated responses are provided for learning support only. They may contain errors and are not a substitute for qualified instruction from your teachers. You must follow your school's academic integrity policies. We do not guarantee specific academic outcomes.
Fees and Payments
Where fee information is displayed, it is provided by your institution for reference. Payment terms, amounts, and any disputes are between you and your school unless otherwise stated. LushAITech is not responsible for billing disputes between users and institutions.
Intellectual Property
The App, its design, software, and content provided by LushAITech are protected by intellectual property laws. Your institution and content licensors may retain rights in educational materials. You receive a limited, non-exclusive licence to use the App for personal or institutional educational purposes.
Third-Party Services
The App may integrate with third-party services (such as Google Sign-In and Firebase). Your use of those services is subject to their respective terms and privacy policies.
Account Suspension and Termination
We or your institution may suspend or terminate your access if you breach these Terms or school policies. You may delete your account through Account settings, subject to your institution's record-keeping requirements.
Disclaimers
THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUSHAITECH AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM, OR INR 1,000, WHICHEVER IS GREATER, WHERE PERMITTED BY LAW.
Changes to Terms
We may modify these Terms at any time. Updated Terms will be posted in the app. Continued use after changes constitutes acceptance.
Governing Law
These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in India, unless otherwise required by mandatory consumer protection law.
